Conflicto de competencia suscitado entre el Tribunal Superior de Pasto, Sala Laboral y el Tribunal Superior de Manizales, Sala Penal.
Luego de reiterar las reglas jurisprudenciales desarrolladas en el Auto 285/17, la Corte considera que la autoridad judicial de Manizales es quien debe asumir de manera inmediata el conocimiento de la acción de tutela de la referencia y, en consecuencia, resolver la impugnación formulada por la accionante contra la sentencia de primera instancia.

- Primero. DEJAR SIN EFECTO la providencia del 13 de febrero de 2017, proferida por el Tribunal Superior de Manizales, Sala Penal de Decisión, dentro del expediente de la acción de tutela promovida por Beatriz Elena González Blandón contra el Instituto Colombiano de Bienestar Familiar -ICBF-.
- Segundo. REMITIR el expediente ICC-2907 al Tribunal Superior de Manizales, Sala Penal de Decisión, para que asuma de manera inmediata el conocimiento de la acción de tutela de la referencia y, en consecuencia, resuelva la impugnación formulada por la tutelante contra la sentencia de primera instancia, proferida el 29 de diciembre de 2016, por parte del Juzgado Penal del Circuito de Aguadas.
- Tercero. Por la Secretaría General de la Corte, COMUNICAR la presente decisión a las partes, al Juzgado Penal del Circuito de Aguadas, al Tribunal Superior de Manizales - Sala Penal de Decisión, y al Tribunal Superior del Distrito Judicial de Pasto - Sala Laboral.
